About these terms
This website is operated by Brenton Partners Limited, registered in England and Wales under company number 09599483, with its registered office at 70 Welland Road, Tonbridge, England, TN10 3TB. In these terms, "we", "us" and "our" mean that company.
By using the site you accept these terms. If you do not accept them, please do not use it. We suggest you keep a copy — we date this page whenever it changes, and the version that applies is the one published when you used the site.
We are a business selling to businesses. This website is not aimed at consumers, and nothing on it is an offer of a consumer contract.
Using this website
You may read, print and share these pages for your own or your firm's internal use, including circulating them to colleagues evaluating Datum. That is what they are for.
You may not:
- use the site unlawfully, or in a way that damages it or interferes with anyone else's use of it;
- attempt to gain access to any part of it, or any system or network connected to it, that is not made available to you;
- introduce anything malicious, or attempt a denial-of-service or similar attack;
- systematically extract its content to build a database or a competing product, or reproduce it commercially without our written permission.
Some of these are also criminal offences under the Computer Misuse Act 1990. If we believe one has been committed we will report it and cooperate with the authorities.
What this website is
It describes a product. It is written to be accurate and we take care over it, but it is general information rather than advice, and it is not a contractual offer or a warranty. Nothing here is legal, regulatory, professional or technical advice for your firm's circumstances, and you should not act on it as though it were.
Before you rely on anything on this site in a decision that matters, ask us to confirm it in writing for your situation. We would rather answer the question than have you assume.
The examples you see
The firms, clients, matters, people, identifiers, match scores and screens shown on this site are invented for illustration. Northgate Wells LLP is not a law firm; Pemberton Holdings is not a company; the people named in the product screens are not people. Any resemblance to a real firm, organisation or individual is coincidence.
Figures shown in illustrations describe how the product behaves on the demonstration data used to produce them. They are not a benchmark, a guarantee, or a prediction of what the product will do on your firm's records — that depends on your data, and we will not pretend otherwise.
Not a conflicts system
Datum is not a conflicts system and issues no clearance decisions. It resolves and governs records, and it can supply better data to a conflicts process, but it does not run conflicts searches, does not clear a matter, and must never be treated as having done so.
Your firm's professional obligations — including those under the SRA Standards and Regulations — remain your firm's, and responsibility for a clearance decision stays with the people your firm has made responsible for it.
Our material
We own or are licensed to use everything on this site: the text, the design, the layout, the diagrams, the product screens, the Datum name and the marks and logos that appear. These are protected by copyright, database right and trade mark law, and the permission in "Using this website" above is the only permission granted.
Where we name someone else's product — a practice management system, a register, a standard — the marks belong to their owners, and naming them implies no endorsement in either direction.
Where we link to another website, we do so because we think it is useful. We have no control over it and take no responsibility for its content.
Availability
We make the site available free of charge and do not promise that it will be uninterrupted, or that its content will always be current. We may change, suspend or withdraw all or part of it without notice, and we may restrict access to parts of it.
Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. That comes first, and the rest of this section is read subject to it.
Subject to that, and because we make this site available free of charge to businesses:
- we exclude all conditions, warranties and other terms that might otherwise be implied into your use of it;
- we are not liable for any loss of profit, revenue, business, contracts, anticipated savings, goodwill or reputation, or for any loss of or corruption of data, arising from your use of the site or reliance on its content;
- we are not liable for any indirect or consequential loss, however arising.
We take reasonable care over this site but do not guarantee it will be free of viruses or other harmful code. Protecting your own equipment and data is your responsibility.
If we work together
These terms govern the website only. Any supply of the Datum platform — a trial, a pilot, a subscription or a deployment — is made under a separate written agreement covering service levels, security, support, fees, intellectual property, liability and data protection. Where that agreement and this page differ, that agreement prevails.
An enquiry through this site is not a contract and does not oblige either of us to enter into one. We treat what you tell us in an enquiry as confidential, and we expect the same of anything we tell you in return.
Changes
We may amend these terms. The current version is always the one on this page, dated at the top, and your continued use of the site after a change means you accept it.
Governing law
These terms, and any dispute or claim arising out of or in connection with them or with your use of this website — including a non-contractual one — are governed by and interpreted in accordance with the law of England and Wales.
The courts of England and Wales have exclusive jurisdiction over any such dispute or claim.
